A young English schoolgirl (name withheld) has surprised people with her decision to sue the hospital in which she was born.
The 9-year-old grl who has been left with lifelong disabilities due to alleged medical failings during her delivery is now bidding for compensation in the courts.
According to Plymouth Herald, the nine-year-old’s lawyers say the damage was done by "excessive traction" being used during her traumatic birth at the Royal Cornwall Hospital in Truro, England.
She was in the "breech" position – upside down – in her mother’s womb and forceps had to be used during her delivery as she emerged into the world feet first.
As medics struggled to free her, nerve roots became acutely stretched between the right shoulder and neck, it is claimed, leaving her disabled.
According to a writ issued at London’s High Court, the end result was severe damage to the nerves which control her right arm, shoulder and upper trunk.
She was "severely handicapped" during her first few months and, although she has made an incomplete recovery, she will always be disabled.
Suing through her father, the girl is now seeking substantial compensation from the Royal Cornwall Hospitals NHS Trust, alleging negligence.
The trust’s defence to the claim was not available from the court and the claims in the writ have yet to be tested before a judge.
